These Terms of Use ("Terms") govern your access to and use of Staked Maps, including stakedmaps.com, the Staked Maps interactive mapping application, subscription features, offline mapping features, Draft A Claim, and related services and content collectively referred to as the "Service."
The Service is operated by Phi McRee Designs LLC, 560 NE F Street Ste A PMB #322, Grants Pass, OR 97526, United States ("Staked Maps," "we," "us," or "our").
By creating an account, purchasing a subscription, or otherwise accessing or using the Service after being presented with these Terms, you agree to be bound by them. If you do not agree to these Terms, do not use the Service.
You must be at least 18 years old to create a Staked Maps account or purchase a subscription.
By creating an account, purchasing a subscription, or using account-based features, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
Subject to these Terms, Staked Maps grants you a limited, personal or internal-business, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for its intended research, mapping, prospecting, rockhounding, and field-planning purposes.
This license does not give you ownership of the Service or any Staked Maps software, design, database structure, original content, or other protectable material.
Except as expressly permitted by these Terms or applicable law, you may not reproduce, redistribute, resell, sublicense, commercially exploit, or create a competing product or dataset from the Service or its protected content.
Normal use of Staked Maps features, including authorized offline downloads and browser caching provided by the Service, is permitted.
Staked Maps is a research, mapping, and field-planning tool.
Staked Maps compiles, interprets, organizes, and displays information from public and government data sources, including records and geospatial information made available by the Bureau of Land Management ("BLM"), state agencies, geological agencies, and other sources.
Staked Maps is an independent private service operated by Phi McRee Designs LLC. It is not operated by, affiliated with, sponsored by, approved by, or endorsed by the BLM, the United States Department of the Interior, or any federal, state, county, or local government agency.
References to government agencies, records, or data sources are provided for identification, attribution, and research purposes.
Staked Maps is not an official government record.
Information displayed through Staked Maps is provided as a research aid and must not be treated as a legal document, title record, certified land-status determination, professional survey, or official government record.
Terms such as "Active," "Current," "Closed," "Historical," "Filed," "Pending," "Under Review," or similar labels generally reflect the status reported or derived from the applicable source records.
A displayed status does not constitute a determination by Staked Maps that a mining claim is legally valid, properly located, enforceable, maintained in compliance with applicable law, or valid against another interest.
Government records can contain errors, omissions, processing delays, inconsistent information, or recently filed information that has not yet appeared in available datasets.
Mining-claim polygons and other claim geometries displayed by Staked Maps are research representations.
Claim geometries may be derived or interpreted from recorded legal land descriptions, Public Land Survey System information, government geospatial records, or other source information. They may represent administrative or geocoded approximations rather than the exact boundaries staked, monumented, surveyed, or recorded on the ground.
A Staked Maps claim polygon must not be used to establish the legal boundary of a mining claim, locate a claim monument, resolve a boundary dispute, or substitute for the official location documents, government case file, county records, field monuments, or a professional survey where one is necessary.
The absence of a current or active mining claim on Staked Maps does not mean that land is open to mineral entry, available for claim location, available for prospecting or collecting, publicly accessible, or free of other legal rights or restrictions.
Land that appears unclaimed may still be affected by circumstances including:
An apparent gap between mapped claims should be treated as a starting point for further research, not proof that ground is legally available.
A surface-management or land-management layer does not, by itself, establish ownership of mineral rights, determine whether land is open to mineral entry, or establish a legal right to prospect, collect minerals, enter property, cross private land, or conduct ground-disturbing activity.
Historical mining claims and documented mineral occurrences are provided as research information.
A historical claim does not establish current mineral rights, current access rights, present-day claim validity, or current availability for mineral entry.
Rockhound Hotspots, mineral-occurrence records, and similar features identify documented occurrences or research leads. They are not guarantees that a material is still present, recoverable, accessible, legally collectible, or located on land where collecting is permitted.
Before entering land, prospecting, collecting, staking a claim, recording a document, disturbing the ground, relying on a boundary, or taking another material action based on information displayed through Staked Maps, you are responsible for verifying current information through the appropriate official sources.
Depending on the situation, those sources may include the applicable BLM state office, BLM's Mineral & Land Records System, county records, state agencies, land-management agencies, property records, recorded mining-claim documents, and on-the-ground monuments or notices.
The Draft A Claim feature and any related generated document, legal-land-description output, map, calculation, certificate, or other material are planning and drafting aids only.

Use of Draft A Claim does not establish or guarantee that:
Draft A Claim does not itself file, record, locate, perfect, or create a mining claim.
Mining-claim requirements vary by jurisdiction and may involve federal, state, county, and local requirements. You are responsible for verifying the requirements that apply to your proposed claim before relying on or submitting any generated material.
Use of Staked Maps or Draft A Claim does not create an attorney-client, surveyor-client, fiduciary, or other professional relationship between you and Phi McRee Designs LLC.
Staked Maps may provide optional features that use your device or browser location.
Device-location information can be inaccurate because of GPS limitations, device hardware, browser behavior, signal conditions, terrain, atmospheric conditions, or other technical factors.
Your displayed position must not be used to establish property lines, mining-claim corners, legal boundaries, survey positions, monuments, mineral ownership, or a legal right to enter or use land.
Staked Maps may allow map information, claim data, map tiles, overlays, or other information to be downloaded or cached for offline use.
Offline or cached information reflects the information available when it was obtained and may become outdated.
It may not reflect subsequent claim filings, closures, withdrawals, land-status changes, access restrictions, government corrections, ownership changes, road conditions, emergency closures, or other developments.
Reconnect to the Service and verify current official information before making a legal, access, staking, or land-use decision.
Staked Maps is not an emergency-navigation, rescue, survival, or backcountry-safety service.
Maps may omit or inaccurately depict hazards, roads, trails, gates, access conditions, private property, closures, terrain, waterways, abandoned mine workings, fire conditions, weather-related hazards, or other conditions.
You are responsible for evaluating actual field conditions and complying with posted signs, private-property rights, permits, closures, land-use restrictions, and applicable laws.
Use of Staked Maps does not give you permission to enter private property, cross restricted land, prospect or collect minerals where prohibited, interfere with another person's valid rights, or conduct ground-disturbing activity.
Never rely solely on Staked Maps to determine whether physical access or activity at a location is lawful or safe.
Creating an account requires a valid email address and authentication credentials.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity performed through your account.
You may not knowingly allow another person to use your credentials to circumvent account, subscription, or access restrictions.
Notify us promptly at info@phimcreedesigns.com if you believe your account has been accessed or used without authorization.
We may take reasonable steps to protect accounts, investigate suspected fraud or abuse, require additional verification, or temporarily restrict access where reasonably necessary to protect users or the Service.
Staked Maps offers free access and paid subscription options.
The current subscription plans, geographic coverage, included features, prices, billing periods, promotional offers, and other purchase terms are displayed on the Staked Maps Pricing page and, where applicable, during checkout.
If information on the Pricing page or checkout differs from an older description elsewhere on the website, the information presented to you as part of the applicable purchase or renewal controls.
Website subscription payments are currently processed by Stripe.
Stripe collects and processes payment-card and billing information under Stripe's own terms and privacy practices. Staked Maps does not store your full payment-card number, card security code, or bank-account credentials.
Unless expressly stated otherwise when you purchase a subscription, paid subscriptions automatically renew at the applicable billing interval until canceled.
By purchasing an automatically renewing subscription, you authorize the applicable recurring charges disclosed to you at checkout until you cancel the subscription.
Before completing a purchase, review the price, billing interval, renewal terms, cancellation terms, and other subscription information presented at checkout.
We may change subscription prices or paid-plan features.
For existing automatically renewing subscriptions, we will provide reasonable advance notice of a material price change when required and will provide any additional notice, consent mechanism, or cancellation information required by applicable law.
A price change will not be applied retroactively to a completed billing period.
You may cancel an automatically renewing subscription using the subscription-management method made available through Staked Maps.
Canceling stops future renewal. Unless otherwise stated or required by applicable law, your paid access will remain available through the end of the billing period for which you have already paid.
Subscription charges are generally non-refundable once a paid billing period begins.
Canceling a subscription does not ordinarily result in a prorated refund for unused time remaining in that billing period.
We will provide refunds, credits, cancellation rights, or other remedies where required by applicable law or where we expressly agree to do so.
Nothing in these Terms limits any refund or consumer right that cannot lawfully be limited or waived.
If a subscription payment fails, is reversed, is disputed, or otherwise cannot be completed, we may suspend or reduce paid access while the payment or subscription status is unresolved.
Subscription cancellation and account deletion are separate actions.
You may initiate deletion of your Staked Maps account through the account-deletion options provided by the Service, through our account-deletion page at /account-deletion, or by contacting info@phimcreedesigns.com.
If you have an active paid subscription, you may need to manage or cancel the subscription separately from deleting your account. Review and complete the applicable subscription-management steps when requesting account deletion.
Deleting your account does not guarantee that a separate recurring payment obligation has been canceled unless the applicable subscription-management process confirms cancellation.
Information concerning how personal information is handled when an account is deleted is described in our Privacy Policy.

We may use reasonable technical and administrative measures to detect, prevent, or respond to prohibited use.
The Staked Maps software, interface, design, branding, original written content, original graphics, database organization, processing methods, and protectable compilations or presentations are owned by or licensed to Phi McRee Designs LLC and are protected to the extent provided by applicable intellectual-property law.
"Staked Maps" and associated original logos and branding are owned by Phi McRee Designs LLC.
Underlying government records, public-domain information, factual data, third-party map materials, and other third-party content remain subject to their respective ownership, public-domain status, licenses, terms, or legal protections.
Displaying, processing, organizing, or interpreting third-party or government information through Staked Maps does not mean Phi McRee Designs LLC claims ownership of material that is not legally ours.
Except for the limited right to use the Service granted under Section 2, these Terms do not transfer any Staked Maps intellectual-property rights to you.
Staked Maps relies on third-party services and information sources to operate portions of the Service. These may include payment processors, hosting and infrastructure providers, mapping services, government databases, public records, and external websites.
Third-party services and websites are operated independently and may be governed by their own terms, privacy policies, licenses, availability, and technical limitations.
A link to or integration with a third-party service does not constitute an endorsement or guarantee of that service or its information.
We are not responsible for changes, outages, errors, omissions, delays, policies, or content controlled by third parties.
We work to keep Staked Maps available and current, but we do not guarantee uninterrupted, error-free, or continuous access to the Service.
The availability and performance of Staked Maps may be affected by maintenance, software changes, internet availability, hosting providers, government-data availability, third-party services, technical failures, security events, or circumstances outside our reasonable control.
We may add, change, replace, restrict, or discontinue features, data sources, map layers, functionality, or portions of the Service.
We do not guarantee that a particular government dataset, map layer, feature, geographic area, offline download, or third-party integration will remain available indefinitely.
Where a change materially affects a paid subscription, we will provide any notice, cancellation right, refund, credit, or other remedy required by applicable law.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
STAKED MAPS MAKES NO WARRANTY, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, OR TIMELINESS.
WE DO NOT WARRANT THAT:
Some jurisdictions do not allow certain warranty exclusions. Where such law applies, these exclusions apply only to the maximum extent permitted by law.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PHI MCREE DESIGNS LLC, STAKED MAPS, AND THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE.
THIS INCLUDES, WITHOUT LIMITATION, CLAIMS ARISING FROM:
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO STAKED MAPS DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes or limits liability that applicable law does not permit us to exclude or limit.
You may stop using Staked Maps at any time.
If you have an automatically renewing paid subscription, stopping use of the Service does not itself cancel future renewal. You must cancel the subscription through the applicable subscription-management process.
We may suspend, restrict, or terminate access to the Service if we reasonably believe that:
Where reasonably practical, we may provide notice before termination, but we are not required to do so when immediate action is reasonably necessary to address fraud, abuse, security, unlawful conduct, or another material risk.
Termination does not affect provisions that by their nature should survive termination, including intellectual-property protections, disclaimers, limitations of liability, payment obligations already incurred, and dispute-related provisions.
We may update these Terms from time to time to reflect changes to the Service, our business practices, applicable law, or other legitimate operational needs.
When we update these Terms, we will update the "Last updated" date at the top of the page.
If we make a material change that significantly affects your rights or obligations, we may provide additional notice through email, the Service, your account, or another reasonable method.
If a material change affects an automatically renewing or continuous-service subscription, we will provide the notice, cancellation information, consent mechanism, or other information required by applicable law.
Where applicable law requires affirmative consent to a revised term, the revised term will not become binding solely through continued use.
Otherwise, your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms.
These Terms and disputes arising from or relating to the Service are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles.
Subject to any non-waivable rights provided by applicable law, any dispute arising from or relating to these Terms or the Service will be brought in an appropriate state or federal court located in Oregon, and you consent to the jurisdiction of those courts.
Nothing in these Terms deprives you of consumer protections, remedies, jurisdictional rights, or other rights that applicable law does not permit you to waive.
These Terms, together with any purchase terms or other terms expressly incorporated into them, constitute the agreement between you and Staked Maps concerning your use of the Service.
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
We may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, change of control, or transfer of the Staked Maps business, subject to applicable law.
Section headings are provided for convenience and do not limit or alter the meaning of these Terms.
Our Privacy Policy explains how Staked Maps collects, uses, stores, discloses, and protects personal information and describes your available privacy choices.
